US Court Orders Release of Abrego Garcia from ICE Detention
A federal judge has ruled the immediate release of Kilmar Abrego Garcia from immigration custody, finding his continued detainment is without lawful basis.
"Since Abrego Garcia's return from wrongful imprisonment in El Salvador, he has been taken back into custody, again without lawful authority," the judge stated in her order.
The case stems from a mistaken removal to El Salvador earlier this year, which US authorities later acknowledged was an error. Following his repatriation to the United States to answer human smuggling allegations, he was held in federal custody.
In her order, the court pointed out that the government does not have a valid deportation order, which effectively blocks them from removing Mr. Abrego Garcia "for now."
Background of the Case
The legal proceedings center on conflicting assertions. Whereas the former administration argues that Abrego Garcia is a affiliate of the MS-13 gang, he categorically disputes this claim.
He has also pleaded not guilty to the smuggling counts, which are part of a separate trial in Tennessee.
Terms of Release
The judge, who was hearing his challenge to deportation in a federal court, determined that he must now adhere to the terms of his release from custody in Tennessee. This order effectively transfers his monitoring to the jurisdiction handling his criminal case.
This decision represents a significant development in a complex legal case featuring claims of mistaken imprisonment and disputed criminal affiliations.
