The former personal attorney for Donald Trump has resigned as the US Attorney for New Jersey. This follows a judicial decision that questioned her legal standing to serve.

Acceptance of Resignation

The head of the Justice Department, Pam Bondi, accepted Habba's resignation on the start of the week. In a statement that the judicial decision made it impossible for her to effectively run her office.

"Let no one confuse adherence to the ruling as defeat," Habba stated. "The effort will now stretch across the nation."

Court Ruling

The departure follows closely on a US appeals court ruled that she had been serving in violation of the law as US attorney. This ruling is expected to impact numerous prosecutions in the state.

The court declared that a temporary posting that did not receive Senate approval violated the statute on vacant positions.

Next Steps and Responses

Bondi said that Habba will remain at the Department of Justice as a senior adviser. Habba plans to pursue additional appeals of the court's action, aiming for a reversal.

On a social media platform, the Attorney General contended that the court "must not override the executive's selection of attorneys entrusted with executing the fundamental role of the presidency of enforcing the law."

Performance in Office

She praised her tenure and noted that under her leadership, the state capital of Newark saw a one-fifth decrease in criminal activity. Additionally that the city of Camden recorded its initial homicide-free summer since 1974 with no murders.

Connection to Donald Trump

The 41-year-old attorney, was initially recruited to Donald Trump's lawyers in 2021. She later acted for Trump in his hush-money trial in 2024, leading to his conviction on 34 counts of financial record manipulation.

Earlier, her appointment to the top New Jersey post, Trump had stated he was naming her as his White House advisor during his second administration, describing her as "unwavering in her loyalty" and a dedicated fighter for justice.
